Conditions Of Rental

The term “equipment” means any and all types of items provided for free usage by Fish Hut & Company to User. Equipment is provided to User at no charge and no transfer of right, title, or interest is given and equipment shall remain the property of Fish Hut & Company. The term “User” means any person and associated parties (Parents, caregivers, relatives, friends) that use any equipment owned by Fish Hut & Company. 

Waiver Of Liability

User understands and accepts that using the equipment exposes User to potential hazards. In recognition of the inherent risks associated with the rental and use of equipment, User confirms for themselves and all on this reservation that they are physically and mentally capable of participating in the activity and using the equipment. User further acknowledge they are participating willingly and voluntarily. User knowingly and freely assume all such risks, both known and unknown, including, but not limited to personal bodily, mental injury, accidents, illnesses, and death, even if arising from the negligence of those persons released from liability herein and assume full responsibility for my participation. User also assumes all responsibility for damage to or loss of personal property (User’s own or damage to others caused by User) as the result of any accident that may occur.

In consideration of services or equipment provided, User, on behalf of their heirs, successors, assigns, next of kin, and personal representatives, do hereby release and forever discharge and hold harmless Fish Hut & Company, its DBAs, principals, directors, trustees, officers, owners, agents, and employees from all liability arising out of the activity and waive any claim for damage arising from any cause whatsoever, including but not limited to all personal, bodily or mental injury, disability, death and loss or damage to person or property, whether caused by the negligence of the those persons released or otherwise. User also agrees to indemnify and hold harmless Fish Hut & Company, its DBAs, principals, directors, trustees, officers, owners, agents, and employees from all claims, judgments and costs, including attorney’s fees, incurred in connection with any action brought as a result of User’s use of equipment.

Compliance with Fishing license and Fishing regulations

User shall comply with all Fishing license requirements and regulations as per specified in their area. 

Photo and Video Release 

User hereby grant us and our agents and affiliates (collectively, the “Released Parties”) permission and a license to take, use, reuse, and publish the likeness of you and any associated parties in all photographs or other electronic and/or digital media in any and all of our publications, including, without limitation, any website entries, advertising websites, and any other marketing materials. You understand and agree that these materials will become the property of the Released Parties and will not be returned. You agree to irrevocably authorize the Released Parties to edit, alter, copy, exhibit, publish, or distribute this media for any lawful purpose whatsoever including, without limitation, promotional and advertising uses. You waive the right to inspect or approve the finished product, including any written or electronic copy, wherein your likeness appears now or in the future.

Acceptance Of Terms And Conditions

User understands and agrees to its acceptance of Fish Hut & Company’s Terms and Conditions upon using any equipment owned by Fish Hut & Company. Should the User not agree with these Terms and Conditions, the User shall not utilize any equipment.
